Automobile Service Contract

This agreement is made this _____ day of _________, 2002 by and between [Company name] (hereinafter referred to as "[Company Name] ) located at [Company address], and ____________________________ (herein referred to as  [Customer] whose residence is ________________________________.

 

PURPOSE OF AGREEMENT

 

            The purpose of this agreement is to state the terms and conditions under which Company Name will provide automobile maintenance and repair services for the Customer’s automobile (hereinafter referred to as “Automobile”) described below:

            NOW THEREFORE, in consideration of the mutual promises herein contained, the parties agree as follows:

 

INITIAL INSPECTION

 

1. (a)  Company Name agrees to perform an initial inspection of the Automobile and provide a WRITTEN STATEMENT of the car’s mechanical/electrical condition. Major defects or conditions discovered during the inspection will be noted below:

 

 

   (b)  The aforementioned defects or conditions will be repaired by Company Name at the customer’s expense, ONLY if customer authorizes such repair in the manner set forth below.  If customer provides no repair authorization these defects or conditions are SPECIFICALLY EXCLUDED  from coverage under this agreement.

CUSTOMER’S EXCLUSIONS

 

At customer’s own option, customer desires to specifically exclude the following defects or conditions from coverage under this Agreement:

 

 

SERVICES TO BE PERFORMED

 

2. Company Name agrees to perform maintenance and repair services as described below:

 

    (a) Company Name will conduct general inspections of the automobile in Spring and Fall.  Customer must bring their automobile into the service station during the month of ______________________ for Spring inspection and during the month of _____________ for Fall inspection.  If customer fails to bring the automobile into Company Name during one or both of these months, the right to enforce the inspection for that time period is waived.

 

    (b) Company Name will perform an annual tune-up, to be scheduled at customer’s convenience. Said tune-up will include LABOR ONLY.

 

    (c) Company Name agrees, except as otherwise provided, to perform all service work required for normal automotive operation, including, but not limited to muffler and brake system repairs, valve cover gasket replacement, radiator flush and refill, tire rotations and lubrication.  All services to be included are limited to those provided by Company Name.

 

    (d)  Company Name agrees to change the oil and oil filter ever 3,000 - 5,000 miles; the cost of oil and filter to be paid by customer.

 

    (e)  Company Name agrees to provide emergency road service if the automobile is within a five (5) mile radius of the Company Name station.  this service  DOES NOT INCLUDE TOWING.

    (f)  Company Name agrees to perform diagnostic services ONLY for MAJOR ENGINE PROBLEMS, TRANSMISSION AND DIFFERENTIAL.  These services  DO NOT INCLUDE THE REPAIR  of diagnosed conditions in these systems.  If the Customer desires Company Name to perform such repairs written authorization will be required.

    (g)  This agreement DOES NOT INCLUDE parts or services for autobody or cosmetic work.

MATERIALS AND SUPPLIES

 

3.  All parts necessary for repair and maintenance work must be provided by Company Name.  No customer-provided parts will be accepted.  The cost of said parts and materials are NOT INCLUDED IN THIS AGREEMENT  and must be paid by customer upon completion of work done by Company Name under this Agreement.

 

SERVICE CONTRACT COST

 

            The Customer shall pay the sum of $149.95 to Company Name, for the services herein agreed to be performed, upon the signing of this agreement.

 

TERM OF AGREEMENT

 

            The term of this Agreement shall commence on the ___________ day of ___________________, 19___, and shall continue in full force and effect for a period of one (1) year from that date.

 

MISCELLANEOUS PROVISIONS

 

(a) Ohio Law to Apply:  This Agreement shall be construed under and in accordance with laws of the State of Ohio, and all obligations of the parties created hereunder are to be performed in County, Ohio.

(b) Legal Construction:  In case any one or more of the provisions in this Agreement shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provision hereof and this Agreement shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein.

(c)  Unless a specific date is indicated within one of the provision of this agreement, Company Name will perform the agreed-upon services during normal business hours.

(d)  this Agreement covers repair and maintenance on both foreign and domestic automobiles.

(e)  Company assumes no liability for damages or injury caused to Customer or Customer’s property that is a result of Customer’s own negligence.
